Welcome to the online store of Nicol Francis Hendruk. These terms and conditions outline the rules and regulations for the purchase of original artworks, fine art prints, and books through this website.

1. General Provisions

By placing an order, you agree to these Terms and Conditions. The seller is Nicol Francis Hendruk (based in the Czech Republic - Rooseveltova 510, Loket, 35733, ČR).

2. Products and Artworks

• Originals: These are unique, hand-drawn/painted pieces. Each comes with a Certificate of Authenticity.

• Fine Art Prints: These are Giclée prints on archival paper. Limited Edition prints are numbered and will not be reprinted once the edition is sold out. Open Edition prints do not have a set limit.

• Representation: I make every effort to display the colors and details of the artworks accurately. However, please note that colors may vary slightly depending on your monitor settings.

3. Pricing and Payment

• All prices are listed in CZK (Czech Koruna).

• Payment is required in full before the artwork is dispatched. We accept payments via the secure methods provided at checkout (e.g., Stripe, PayPal, or Bank Transfer).

4. Shipping and Delivery

• Standard Processing: Prints and postcards are typically packaged and shipped within 1–3 business days.

• Framed Works: If you request framing, please allow up to 14 days for dispatch.

• International Shipping: We ship worldwide. Any customs duties or import taxes incurred for international orders are the sole responsibility of the buyer.

5. Returns and Withdrawals (EU Consumer Rights)

Under EU law, you have the right to withdraw from your purchase within 14 days of receiving the goods.

• Conditions: The item must be returned in its original, undamaged condition and original packaging.

• Exceptions: Please note that custom-made items (such as artworks specifically commissioned or framed at your request) are exempt from the standard 14-day return policy.

• Return Shipping: The cost of return shipping is covered by the buyer.

6. Intellectual Property (Copyright)

When you purchase a piece of art, you own the physical object. However, Nicol Francis Hendruk retains all copyrightsto the artwork.

• You may not reproduce, scan, or use the artwork for commercial purposes without express written permission from the artist.

• The artist reserves the right to create prints of original works unless otherwise agreed.

7. Limitation of Liability

The artist is not responsible for damages caused by the shipping provider, though all items are insured and packaged with the utmost care to prevent damage. In the event of damage during transit, please contact me immediately with photos of the packaging and the artwork.

8. Governing Law

These terms are governed by the laws of the Czech Republic. Any disputes shall be resolved through the Czech Trade Inspection (ČOI) or the relevant courts in the Czech Republic.
